Terms and conditions
These General Terms and Conditions apply to all treatment and care agreements between MSK Centrum
(hereinafter: “the Practice”) and the client/patient (hereinafter: “client”), unless otherwise agreed in writing.
By making an appointment, receiving treatment, or otherwise using our services,
the client declares to have taken note of these General Terms and Conditions and to agree to them.
1. Definitions
- Practice: MSK Centrum, including all practitioners and employees acting on behalf of the Practice.
- Client: the person receiving treatment or making an appointment at the Practice.
- Treatment Agreement: the agreement between the client and the Practice in which the treatment and care provision are established.
- Treatment: all services, advice, examinations, and (after)care offered by the Practice.
2. Applicability
These General Terms and Conditions apply to every treatment agreement and to all appointments, consultations,
treatments, and other services provided by the Practice. Deviations are only valid if they have been expressly
agreed upon in writing.
3. Formation of the treatment agreement
A treatment agreement is formed at the moment the client makes an appointment (by telephone, email,
via the website, or otherwise) and/or presents themselves for treatment, and the Practice confirms this appointment or
commences the treatment.
4. Treatment and best-efforts obligation
The Practice performs the treatment to the best of its knowledge and ability and in accordance with the requirements that
may be expected of professional healthcare provision. The Practice has a best-efforts obligation and cannot provide a guarantee of results.
The client provides all information that is reasonably relevant for proper treatment (such as medical
history, medication use, complaints, and limitations). Incorrect or incomplete information may affect the treatment;
the Practice is not liable for this.
5. Appointments, changes, and cancellations
If the client is unable to attend, they must cancel or reschedule the appointment in a timely manner. As a guideline:
cancel no later than 24 hours before the appointment (on working days).
In the event of late cancellation or failure to appear for the appointment (no-show), the Practice may charge the reserved
treatment rate (or a portion thereof). These costs are generally not reimbursed by the health insurer.
6. Rates, invoicing, and payment
The Practice uses rates that are available upon request and/or may be listed on the website.
Reimbursements from the health insurer depend on policy conditions and any contracts with insurers.
If possible, the Practice bills the health insurer directly. Treatments that are not (fully)
reimbursed, or costs that are for the client’s account (such as no-shows), will be invoiced to the client.
Invoices must be paid within the term stated on the invoice. In the absence of payment, the Practice may
(after a reminder) take collection measures. Any reasonable collection costs may be passed on in accordance with
statutory regulations.
7. Records and retention periods
The Practice maintains a (medical) record as far as this is legally and/or professionally required. Retention periods
are applied in accordance with current laws, regulations, and professional guidelines.
8. Privacy and data processing
The Practice processes personal data and (if applicable) medical data in accordance with the
General Data Protection Regulation (GDPR) and other applicable legislation. For more information, please refer
to the Privacy Statement on our website.
9. Liability
The Practice is only liable for damage that is the direct result of intent or gross negligence by the Practice.
To the extent that the Practice is liable, liability is limited to the amount paid out in the relevant case by
the Practice’s liability insurance, increased by any deductible.
The Practice is not liable for damage resulting from the client providing incorrect or incomplete information,
failing to follow instructions or advice correctly, or damage due to force majeure.
10. Complaints procedure
Do you have a complaint? Please discuss this first with your practitioner or with the Practice, so that we can reach a solution
together. If this does not lead to a suitable solution, the client can make use of the complaints procedure as
used by the Practice (available on request).
11. Amendments
The Practice may amend these General Terms and Conditions. The most current version is published on the website.
Amendments apply from the moment of publication, unless otherwise stated.
12. Applicable law and disputes
Dutch law applies to all legal relationships between the client and the Practice. Disputes are preferably
resolved through mutual consultation. If that is not successful, the dispute will be submitted to the competent court.
