Definitions<\/strong><\/p><ul><li><strong>Practice:<\/strong> MSK Centrum, including all practitioners and employees acting on behalf of the Practice.<\/li><li><strong>Client:<\/strong> the person receiving treatment or making an appointment at the Practice.<\/li><li><strong>Treatment Agreement:<\/strong> the agreement between the client and the Practice in which the treatment and care provision are established.<\/li><li><strong>Treatment:<\/strong> all services, advice, examinations, and (after)care offered by the Practice.<\/li><\/ul><p><strong>2. Applicability<\/strong><\/p><p>These General Terms and Conditions apply to every treatment agreement and to all appointments, consultations,<br>treatments, and other services provided by the Practice. Deviations are only valid if they have been expressly<br>agreed upon in writing. <\/p><p><strong>3. Formation of the treatment agreement<\/strong><\/p><p>A treatment agreement is formed at the moment the client makes an appointment (by telephone, email,<br>via the website, or otherwise) and\/or presents themselves for treatment, and the Practice confirms this appointment or<br>commences the treatment.<\/p><p><strong>4. Treatment and best-efforts obligation<\/strong><\/p><p>The Practice performs the treatment to the best of its knowledge and ability and in accordance with the requirements that<br>may be expected of professional healthcare provision. The Practice has a best-efforts obligation and cannot provide a guarantee of results. <\/p><p>The client provides all information that is reasonably relevant for proper treatment (such as medical<br>history, medication use, complaints, and limitations). Incorrect or incomplete information may affect the treatment;<br>the Practice is not liable for this. <\/p><p><strong>5. Appointments, changes, and cancellations<\/strong><\/p><p>If the client is unable to attend, they must cancel or reschedule the appointment in a timely manner. As a guideline:<br>cancel no later than 24 hours before the appointment (on working days). <\/p><p>In the event of late cancellation or failure to appear for the appointment (no-show), the Practice may charge the reserved<br>treatment rate (or a portion thereof). These costs are generally not reimbursed by the health insurer. <\/p><p><strong>6. Rates, invoicing, and payment<\/strong><\/p><p>The Practice uses rates that are available upon request and\/or may be listed on the website.<br>Reimbursements from the health insurer depend on policy conditions and any contracts with insurers.<\/p><p>If possible, the Practice bills the health insurer directly. Treatments that are not (fully)<br>reimbursed, or costs that are for the client&#8217;s account (such as no-shows), will be invoiced to the client. <\/p><p>Invoices must be paid within the term stated on the invoice. In the absence of payment, the Practice may<br>(after a reminder) take collection measures. Any reasonable collection costs may be passed on in accordance with<br>statutory regulations.  <\/p><p><strong>7. Records and retention periods<\/strong><\/p><p>The Practice maintains a (medical) record as far as this is legally and\/or professionally required. Retention periods<br>are applied in accordance with current laws, regulations, and professional guidelines. <\/p><p><strong>8. Privacy and data processing<\/strong><\/p><p>The Practice processes personal data and (if applicable) medical data in accordance with the<br>General Data Protection Regulation (GDPR) and other applicable legislation. For more information, please refer<br>to the Privacy Statement on our website. <\/p><p><strong>9. Liability<\/strong><\/p><p>The Practice is only liable for damage that is the direct result of intent or gross negligence by the Practice.<br>To the extent that the Practice is liable, liability is limited to the amount paid out in the relevant case by<br>the Practice&#8217;s liability insurance, increased by any deductible.<\/p><p>The Practice is not liable for damage resulting from the client providing incorrect or incomplete information,<br>failing to follow instructions or advice correctly, or damage due to force majeure.<\/p><p><strong>10. Complaints procedure<\/strong><\/p><p>Do you have a complaint? Please discuss this first with your practitioner or with the Practice, so that we can reach a solution<br>together. If this does not lead to a suitable solution, the client can make use of the complaints procedure as<br>used by the Practice (available on request).  <\/p><p><strong>11. Amendments<\/strong><\/p><p>The Practice may amend these General Terms and Conditions. The most current version is published on the website.<br>Amendments apply from the moment of publication, unless otherwise stated. <\/p><p><strong>12. Applicable law and disputes<\/strong><\/p><p>Dutch law applies to all legal relationships between the client and the Practice. Disputes are preferably<br>resolved through mutual consultation.
